By accessing or using Canada Well Finder, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use this service. By using Canada Well Finder, you represent that you meet this requirement.

Description of Service

Canada Well Finder provides access to oil and gas well data across Canada, including:

  • Interactive mapping of 900,000+ wells across Alberta, BC, Saskatchewan, Manitoba, and Ontario
  • Well search by location (LSD, NTS), name, or license number
  • Production data for Alberta and Saskatchewan wells
  • AI-powered well and company analysis (requires credits)
  • Ability to save pinned wells, annotations, and preferences (requires account)

User Accounts

Some features require a registered account. When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these terms.

User Content

By uploading annotations, files, or other content to Canada Well Finder, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and transmit that content solely for the purpose of providing the service to you.

You represent and warrant that you have the right to upload any content you submit, and that such content does not infringe any third party's intellectual property, privacy, or other rights, and does not contain unlawful material.

Acceptable Use

You agree not to:

  • Use automated systems (bots, scrapers) to access the service without permission
  • Attempt to bypass rate limits or security measures
  • Upload malicious, infringing, or unlawful files or content
  • Use the service for any illegal purpose
  • Resell or redistribute bulk data without authorization
  • Misrepresent your identity or affiliation

Intellectual Property

Well Data: The underlying well data is sourced from provincial regulatory bodies (AER, BC OGC, Saskatchewan Ministry of Energy and Resources, Manitoba Petroleum Branch, Ontario Ministry of Natural Resources) and is public information. We aggregate and present this data but do not guarantee its accuracy or completeness.

Our Service: The Canada Well Finder platform, including its design, interface, code, and aggregated data presentation, is protected by copyright. You may not copy, modify, or distribute our platform without permission.

Payment Terms

AI analyses and certain exports require credits, which can be purchased through our platform:

  • All payments are processed securely by Stripe
  • Prices are in Canadian dollars (CAD) unless otherwise stated
  • Credits are added to your account immediately upon successful payment
  • Credits are non-refundable once purchased
  • Credits do not expire

New accounts receive 5 free credits. Free credits are one-time only and do not replenish.

Data Accuracy Disclaimer

Important: Well data is provided "as is" from provincial regulatory sources. While we strive to keep data current and accurate:

  • We do not guarantee the accuracy, completeness, or timeliness of any data
  • Data may contain errors or be outdated
  • Always verify critical information with official regulatory sources
  • We are not responsible for decisions made based on this data

AI Analysis Disclaimer

AI-generated well and company analyses are provided for informational purposes only:

  • AI analyses are generated by third-party AI services and may contain errors or inaccuracies
  • Analyses should not be considered professional geological, engineering, legal, or investment advice
  • Always consult qualified professionals before making business or investment decisions
  • We are not liable for any decisions made based on AI-generated content

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, or secure, or that any defects will be corrected. You use the service at your own risk.

Limitation of Liability

To the maximum extent permitted by law, Canada Well Finder and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the service.

Our total liability for any claim arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Canada Well Finder and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the service
  • Your violation of these terms
  • Content you upload or submit
  • Your violation of any third party's rights
  • Your violation of any applicable law or regulation

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service:

  • The service may be unavailable due to maintenance, updates, or technical issues
  • We reserve the right to modify or discontinue features at any time
  • We will make reasonable efforts to notify users of significant changes

Termination

You may close your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these terms without prior notice. Upon termination:

  • Your access to the service will be revoked
  • Unused credits are forfeited and non-refundable
  • Your data may be deleted in accordance with our Privacy Policy

Governing Law and Disputes

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these terms or your use of the service shall be resolved by binding arbitration administered by the ADR Institute of Canada under its arbitration rules, with arbitration taking place in Calgary, Alberta. Either party may seek injunctive or other equitable relief in the courts of Alberta for matters requiring immediate remedy.

Class Action Waiver: You agree to resolve disputes with us individually. You waive any right to participate in a class action, collective action, or representative proceeding against Canada Well Finder.

Small Claims Exception: For claims under $10,000 CAD, you may pursue resolution in the Provincial Court of Alberta (Civil Division) instead of arbitration.

General Provisions

Entire Agreement: These terms, together with our Privacy Policy, constitute the entire agreement between you and Canada Well Finder regarding your use of the service.

Severability: If any provision of these terms is held to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these terms without our prior written consent. We may assign our rights and obligations without restriction.

Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of war or terrorism, internet or infrastructure outages, third-party service failures, labour disputes, or government actions.

Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms. Significant changes will be announced via email to registered users. We encourage you to review these terms periodically.
